  1. 1.Introduction

    ShardaEats was born from a simple observation: hospital food ordering was stuck in the past. Patients and their families were struggling with complicated phone orders, limited menu visibility, and unpredictable delivery times.

    These Terms of Use ("Terms") govern your use of the website shardaeats.com and the Sharda Eats mobile application (collectively referred to as the "Platform"). The Platform is owned, operated, and managed by Maxwell Hotels Private Limited ("Company," "We," "Us," or "Our").

    By accessing, browsing, or using the Platform, you ("User," "You," or "Your") agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the Platform immediately.

  2. 2.Eligibility & Account Services

    2.1 Age Requirement: You must be at least 18 years of age or the age of legal majority in your jurisdiction to use our services.

    2.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials (username and password) and for all activities that occur under your account.

    2.3 Accurate Information: You agree to provide true, accurate, and current information (including delivery location within Sharda Care premises/hospital wards) during registration and while placing orders.

  3. 3.Service Description

    Sharda Eats is an in-house food delivery solution designed to facilitate the ordering of food and beverages ("Items") specifically within the operational ecosystem of Sharda Care. We provide the technology platform to connect you with our in-house kitchens or designated food partners.

  4. 4.Ordering, Pricing, and Payments

    4.1 Order Placement: When you place an order on the Platform, it constitutes an offer to buy the items. The contract is binding only when you receive a confirmation notification from us.

    4.2 Pricing: All prices listed on the Platform are in Indian Rupees (INR). Prices are subject to change without notice at the discretion of Sharda Care.

    4.3 Taxes & Charges: The total price displayed at checkout includes the price of the items, applicable taxes (GST), packaging charges, and delivery fees (if any).

    4.4 Payment: You agree to pay the full amount using the authorized payment gateways available on the Platform (UPI, cards, net banking).

  5. 5.Cancellation and Refund Policy

    5.1 Strict No Cancellation: As Sharda Eats operates on a rapid‑fulfillment model within a specific facility, we maintain a strict no‑cancellation policy. Once you confirm an order and payment is processed, the order is immediately routed to the kitchen for preparation. You cannot cancel, withdraw, or modify the order once placed.

    5.2 No Refunds: We do not provide refunds for orders where the user changes their mind, selects the wrong item, or is unavailable to receive the order at the designated location.

    5.3 Company's Right to Cancel: Sharda Eats reserves the right to cancel your order if:

    • The item is unavailable.
    • The delivery address is outside our service zone.
    • There is a technical error in pricing or specifications.
    • In such cases driven by the company, a full refund will be initiated to the original source of payment.
  6. 6.Delivery

    6.1 Delivery Areas: Delivery is restricted to specific zones as defined by Sharda Care management.

    6.2 Timelines: Users are advised Estimated delivery times are indicative. While we strive to deliver on time, we are not liable for delays caused by high order volume, operational issues, or force majeure events.

  7. 7.Disclaimers & Limitation of Liability

    7.1 Food Quality: While we ensure strict hygiene protocols, the description of items (including images) is for reference only and actual items may vary slightly.

    7.2 Allergens: Users are advised to review ingredients carefully. Sharda Eats is not liable for allergic reactions or dietary issues resulting from the consumption of items, except in cases of proven gross negligence.

    7.3 “As Is” Basis: The Platform is provided on an “as is” and “as available” basis. We do not guarantee that the Platform will be error‑free, uninterrupted, or meet every user’s expectations, and our liability is limited to the maximum extent permitted by law.

  8. 8.Intellectual Property

    All content on the Platform, including text, graphics, logos, button icons, images, and software, is the property of Sharda Care and is protected by Indian and international copyright laws.

  9. 9.Governing Law

    These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in Greater Noida, Uttar Pradesh.
